In 4-3 Vote, Court Says Paterson Can Appoint Lt. Governor

The New York State Constitution does not provide for if and how a vacancy inthe office Lieutenant Governor should be filled.  When Governor Eliot Spitzer resigned and David Paterson became Governor, the issue was raised over if the Governor had the authority to appoint his replacement.  The court case affirment that the governor does have this right, it is a matter that customarily would be adressed in the State Constitution.
