ALBANY — A judge has turned down a petition from state Senate Democrats trying to block creation of a 63rd Senate district in New York.

State Supreme Court justice Richard Braun says in a decision Friday that he found it "disturbing" the Republican majority in control of redistricting used two different methods for establishing boundaries in Queens, Staten Island and Nassau and Suffolk counties.

But he says the Democrats didn't establish that process was unconstitutional.

The Democrats say they'll appeal the decision by the trial-level judge. A GOP spokesman says they're pleased by the ruling.

Majority lawmakers in the Senate and Assembly struck a deal with Gov. Andrew Cuomo last month to approve new election maps that critics say were drawn to help protect their political power for the next decade.
